General Terms and Conditions for Attendees at the Cannes International Emigration & Luxury Property Expo 2017 These General Terms and Conditions for the Cannes International Emigration & Luxury Property Expo 2017 (hereinafter, the Exhibition) determine the basic rules for attendee behavior on the premises of the Palais des Festivals et des Congres (the halls, rooms, and conference facilities) where the Exhibition is held, including the terms for refunds in the event the attendee fails to visit the Exhibition. For the purposes of these General Terms and Conditions for Attendees, an attendee is a person who purchases a ticket for admission to the Exhibition, being properly registered as an attendee (guest), and having obtained an individual attendee pass (badge), which confers the privilege to be admitted to the Exhibition on the dates indicated below. Type and title of event: Cannes International Emigration & Luxury Property Expo 2017 Date, venue, and address of event: October 26-27, 2017. Palais des Festivals et des Congres (1 Boulevard de la Croisette, 06400 Cannes, France). Time of event: Exhibition: 10:00 – 19:00 Entrance to the exhibition-conference is limited to those who have a registered ticket bearing a QR code authorizing admission to the hall. Transfer or sale of individual attendee passes (badges) to third parties is prohibited. The Organizer has the right to verify the name on the badge and the name of the attendee, and may ask for an identity document. Attendees must leave the Exhibition premises not later 19.00 p.m. on October 26 and 27, 2017. The Organizer has the right to refuse entry to any attendee without explanation, and/or to forcibly expel him from the Exhibition. It is strictly forbidden for attendees to engage in trade at the Exhibition or to distribute advertising and information products, to make presentations, demonstrations, protests, or other similar events or actions. Attendees must dress and comport themselves in accordance with the business nature of the Exhibition, and comply with generally accepted norms of behavior. They are expected to refrain from disruptive behavior during the Exhibition. Intoxication by alcohol or drugs is strictly prohibited on the premises of the Exhibition. An attendee shall carefully review and strictly comply with the General Terms and Conditions of the Exhibition. In the event the rules are violated, the attendee is obliged to leave the premises immediately. The Organizer is not responsible for the safety of attendees’ personal belongings during the Exhibition, nor for the actions of third parties on the premises. Attention: in accordance with the Application of decree n° 2006-1386 dated 15th November 2006, it is strictly forbidden to smoke within the buildings of the Palais des Festivals et des Congrès de Cannes from 1st February 2007. Articles R 3511-1 to R 3511-8 apply within all their measures as well as articles R 3512-1 and R 3512-2 regarding fines incurred by the offenders, in particular by each attendee personally. The Organizer may deny entry to the Exhibition to any attendee found to be in violation of these General Terms and Conditions of the Cannes International Emigration & Luxury Property Expo 2017, without recourse or refund of fees. Additional regulations may be issued for specific cases. An attendee shall undertake to comply scrupulously with the purpose of the premises and specific layouts as it is a public venue and shall, for the purposes directly applicable to the attendee, comply with the conditions laid down in the Order (Revised) of 25th June 1980 concerning safety and risks of panic in Public Venues. For information, and without the list being exhaustive, the main requirements are as follows: For rooms used for auditions, conferences, and meetings, the conditions laid down in Articles L.1 to L.89 of the said Order. Attendees must commit themselves to comply the fire security regulations established for the Palais des Festivals et des Congrès de Cannes by the regional security board, and with internal security rules. An attendee shall not have any claim, for any reason whatsoever, against the Organizer, and shall be responsible for following regulations of the Palais des Festivals et des Congres, including general conditions and terms of use of the premises. Briefly, the organisation and production of a public event is impacted by laws and regulations of the French national health and pensions organization, tax laws, laws governing intellectual property rights and royalties (as authorized by SACEM), branding laws, reproduction rights, consumer laws, and the fight to end tobacco addiction (EVIN Law 91-32 from 10 January 1991). Smoking is not permitted inside the Palais des Festivals et des Congrès building. Guests shall discharge the Organizer and Palais des Festivals et des Congrès from any obligation or responsibility in this respect. A guest shall be responsible, vis-à-vis the Palais des Festivals et des Congrès and third parties, for their own acts, imprudence, or failure to comply with any clause of the regulations and instructions from the Palais des Festivals et des Congrès, including maintaining facilities they occupy in good condition. The Organizer’s obligation is expressly limited to the provision to Exhibition’s attendees with infrastructure, premises and services that comply with current regulations for the purposes of the Exhibition. Any intervention on the part of police directly associated with the attendee’s acts and/or their behavior shall be invoiced directly to such attendee. The attendee’s right to attend the Exhibition due to the purchase of a ticket shall be personal, non-assignable, and non-transmissible. It is therefore expressly forbidden to assign or exchange it, free of charge or for valuable consideration, to any person. The attendee’s presence at the Exhibition must not, under any circumstances, damage the permanent installation of the Palais des Festivals et des Congrès or impair its security and safety systems, must not affect the appearance or solidity of the halls, buildings, outbuildings, and furnishings of the premises where the Exhibition is held. Attendees are required to comply with regulations and instructions from the Palais des Festivals et des Congrès that affect the circulation of vehicles within the area or outbuildings of the Palais des Festivals et des Congrès, and comply with weight restrictions on vehicles using concrete surfaces. The security perimeters and access roads shall remain free of alteration, materials, equipment, and vehicles. Access to the façades, standpipes and fire hydrants shall not be blocked at any time. This excludes any vehicle from parking in the immediate vicinity of a façade while the Exhibition is held. The Palais des Festivals et des Congrès provides services, and takes responsibility for the use, for the purposes of the event, of existing or designated cloakrooms. However, the liability of the Palais des Festivals et des Congrès shall remain limited to theft, disappearance or substitution of clothing or objects deposited in return for a numbered token. It shall never extend to the contents of such clothing or objects (money, keys, jewelry, documents, etc.). The disposal of materials, items and residual waste shall be undertaken by the attendee using the designated places within the Exhibition building. Attendees shall agree in advance not to seek recourse or impleader against the Organizer, and shall guarantee the Organizer to be against any Court ruling linked to the Organizer’s activity. The Organizer shall have no liability whatsoever for theft or any other losses or damages caused to an attendee and/or their property or personal effects. Attendees are strongly advised to insure their valuables. In case an attendee opts out of attending the Exhibition after buying a ticket, it shall notify Organizer about its decision in writing. The refusal shall be deemed to be made on the date of receipt of such notice by Organizer rather than on the date of posting. For the purposes of these General Terms and Conditions of the Cannes International Emigration & Luxury Property Expo 2017, such attendee’s refusal shall mean refusal to attend the Exhibition at large during its entirety. When the refusal date is prior to September 27, 2017, Organizer shall refund to the attendee 70% of the total value of the ticket. In other cases, Organizer has no obligation to refund money to the attendee for a ticket purchased by them, with the exception that the Organizer may at its discretion offer refunds if it cancels the Exhibition.
